Coaching
Coaching is partnership (defined as an alliance, not a legal business partnership) between a Coach and a Client intended to prompt reflection and inspire a client to design and enact changes that matter to them.
Your coach cannot promise that you will take any specific actions or attain any specific outcomes – where you go and what you do is down to you and commitment to the coaching process. The client is responsible for his/her decisions, choices, and actions arising from coaching interactions or reflections: the coach is not and will not be liable for any actions or inaction, or for any direct or indirect result of services provided by the coach.
Coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
The Coach agrees to maintain the ethics and standards of behaviour established by the EMCC code of ethics. It is recommended that the Client review the EMCC code of ethics and the applicable standards of behaviour.
Coaching logistics
Our coaching sessions will be one hour in duration (unless otherwise agreed), over Teams or by telephone. We will either agree a mutually convenient time for the next coaching session at the end of our session, or you can email me at info@careforyoucoaching.co.uk to book a slot. Our scheduling will be guided by your availability and needs from coaching.
Rescheduling
You can also contact me at this email address if you wish to reschedule: please do so 72 hours before the scheduled booking.
If you do not give 72 hours’ notice to reschedule a session then the session will be deemed as taken, except at my discretion. I will wait until 15 minutes after the scheduled start time before deeming the session as unattended if I have not received communication from you. Any sessions joined late will conclude at the original scheduled time, unless otherwise agreed with me.
Cancellation
If you need to cancel a coaching session, please email me at info@careforyoucoaching.co.uk 72 hours before the scheduled booking to avoid a cancellation charge. As coach, I reserve the right to charge you for a missed meeting. Cancellations within 72 hours are charged at 100% of the session rate of the coaching. I will do everything possible to reschedule a missed meeting.
My coaching could potentially be affected by events beyond my reasonable control (e.g. IT issues, problems with internet connectivity, illness). I will take reasonable steps to limit the impact of any such events, to keep you informed of the circumstances, and to resume coaching as soon as any eventualities have been fixed.
Termination
If you no longer wish to continue with the coaching relationship, you are free to leave at any time (please simply inform your coach to cancel any sessions).
Confidentiality
Coaching discussions are confidential. Sessions notes are taken in accordance with the Global Code of Ethics for Coaches and Mentors. As part of my coaching practice, I receive regular supervision and it is possible that situations from coaching will be discussed with my supervisor. If this happens you will remain anonymous and no personally identifying details will be disclosed.
All information shared by you will be kept strictly confidential, except when releasing such information is required by law and/or where I consider it necessary to do so because of concerns of risk to yourself or others.
Feedback
At the conclusion of our coaching I will also be asking you for a testimonial about your experience of the coaching process through a questionnaire. This is optional, and no financial compensation is offered for a testimonial.
If you provide a testimonial, this will be used to promote Care for You Coaching to other potential clients (e.g. for example social media posts, on the company website). You will be asked for your consent to use your testimonial in this way, to have the testimonial edited (whilst preserving the key message), and to have the testimonial kept on file. The testimonial would be publicised anonymously.
Limited Liability
The Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to you (the Client) for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach for all coaching services rendered through and including the termination date.
Resolving problems
In the unlikely event that there is a problem with my coaching services, you will contact me in the first instance and give a reasonable opportunity to mitigate any problems. If a dispute arises out of the coaching agreement that cannot be resolved by mutual consent, the I will work with you to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover any legal fees and court costs from the other party.
Force Majeure
Care for You Coaching is not liable for any failure to provide services (whether paid and/or scheduled) if such failure is as a result of Acts of God (including flood, fire, earthquake, storm, hurricane, or other natural disaster), war, invasion, or any other hostilities or civil or political disruption (regardless of whether or not war is declared). I will take reasonable steps to limit the impact of any such events, to keep you informed, and to resume coaching if and when possible.
Intellectual property
If I provide you with any digital materials, the intellectual property of those materials belongs to me, unless I agree otherwise. You can use these materials for your own personal learning only: they cannot be shared with third parties.
Cooling off period
You have the right to cancel your coaching within 14 days of payment without giving any reason, and your payment will be reimbursed via the original means of payment you used.
Refunds
If I cancel a programme, you are entitled to a refund for the sessions which you have paid for in advanced and which you have not received. If you do not give 72 hours’ notice to cancel a session/programme of coaching then the session/programme will be deemed as started, except at my discretion, and you will be charged. This no-refund within 72 hours of a session policy is to help build your own commitment to coaching, and to reflect that my time will go into session preparation ahead of our coaching.
Severability
In the event that provisions of our original agreement on services are not enforceable, they will not invalidate the entire contract. Instead, the contracting parties will work together on an appropriate adjustment of these provisions to correspond as closely as legally possible to the original intentions.
No assignment
The coaching sessions in the Welcome Pack will be provided to the person who signs the contract. The sessions cannot be assigned to another person. The only exception to this is where two parties (parents) might sign up for coaching as part of the ‘Coaching to support parents of children in Autism/ADHD assessment pathways programme’ but only one parent can attend a session.
Changes to Terms and Conditions
Care for You Coaching reserves the right to revise these terms at any time, and inform you of updates to these terms and conditions.
Governing Law
These Terms and Conditions shall be governed and construed in accordance with the laws of England and Wales. Any dispute arising out of, or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
